Don't the right-to-repair laws kind of squash this legislation completely? The consumer has a right to repair their own vehicle. If all it takes is hitting an "Apply" button, that absolutely should count.
This OTA upgrade thing seems more like protection for the auto dealerships to me. They want to force consumers to go into a dealership to have software updates applied. Presumably so the dealership can charge a fee or include it with their vehicle maintenance plans they sell with the vehicle. Lots of bias there in the proposed legislation that targets newer vehicles, specifically EVs and those with a lot of the newer tech or bells and whistles. This is also a state that has an additional $450 in registration fees for "efficient" vehicles and sadly their qualifier for "efficient" is anything that is a BEV, hybrid, or an ICE that gets better than 24MPG.They are trying to stop the "pay to upgrade" scheme OEMs really want to get to. I'm both for this and not.
it's scam legislation for the dealers, I say F the dealers, they do not need to make money off of software updates. Going to the dealer is a safety issue, you could crash on the way to or from, you could have a heart attack as the dealer is trying to rip you off, but worse, many people do not go get critical safety updates in a timely fashion because they are busy, etc. OTA updates happen while the car is parked at night, it's a win for the manufacture, and consumer, F the dealer.This OTA upgrade thing seems more like protection for the auto dealerships to me.
